I guess I am trying to understand how a juvenile judge does not understand yet, at this point in his career, whom he has jurisdiction over. It sounds to me that the juvenile judge should have known this. How on earth can yet another delay be caused because of negligence.
1. This is the age of technology. We can talk to people face to face on the computer when they live in other countries but a judge cannot pick up a phone or punch in a keyboard to a Superior Court Judge to clarify a simple question as to whether or not he is at liberty to hold a detention hearing.
How on earth can that be? We are talking about a child who has plead innocent for THREE years. Lets recall video court appearances, they are very prevalent today. Yet no one can use technology to correct his matter. ?
2. When the Superior Court received the request, could they not contact the Judge to let him know that HE has jurisdiction on this matter? This would have taken about a minute. The judge could have set the date and this matter could have been resolved within a week of him denying the initial request. It did not matter whether or not the newspaper appeal was still pending a possible appeal. The fact for the hearing was based solely on a violation of Jordan's right to a speedy trail. We are talking about the constitution of the United States hear. How many people can pass the issue on when it is written clearly for ALL of them to see?
3. Does everyone understand why their taxes go up, up, up, every year? Pure negligence. This should not even be permitted on any level.
Three years, no trial. Three years, no help for a child's emotional needs. I am referring to an innocent child locked up for "Three years" with no help at all. Three years, Jordan's family has to travel back and forth to Erie and still literally "nothing" going on. The newspapers had more rights to demand to be at a hearing, than a child had for a right to a speedy trial. It is clear to me that Jordan actually should have been released once they held up the trial date. If Judge Hodge does not see this, there really needs to be an outside investigation here.
It seems that maybe someone in authority in Pennsylvania needs to take some responsibility and do what is right here. This is beyond words at this point.
