How I want to possesses the defense counsel's body! I would rake all of the prosecution witnesses through the coals. That is why I love cross-examinations to be as adversarial and maybe a little intimidating as possible, for I know my opposite consel will have no mercy on my client or his witnesses.

In James' case, no holds barred. I would grill every last one of them, including the kids. All I I want is for them to slip up and show the jury their true colors.

James' mom and stepdad for instense need it real bad. So do every person who was in the house with the accused and the victim. I would also if I knew the scumbag who is behind the frame-up served with papers to appear on the stand as a Hostile Witness. I want to uncover every piece of evidence that all of these witnesses conspired to frame the defendent to keep them from facing jail time themselves.

If they all have criminal records, the defense should use them at all costs. "I see you in that year committed this crime, which in this year you served X time in jail and paid X dollars in fines, court costs and restution." Using their past against them is bound to unhinge them. So would their parenting, past abuse of the accused and their use of intoxicating substances. The goal, as both sides know, is to unhinge the witness to make them look bad to the jury.

The jury has to be convinced that the police and the prosecution is perverting the course of justice! In order for that to happen, defense must do more damage to the prosecution than the prosecution can patch up with their dirty tactics. These men and women of the jury should be made to know not all cops are perfect, forensics are not all good like on CSI or Law and Order; and, most important of all be made to believe that the real victim is the accused and the real crooks are those prosecuting this case.

We must trust in the wisdom and goodwill of our fellow-citizens who have been seated on the jury. They are not like members of Congress. They do not need to be lobbied to know what’s right. They are like you and me.

It could mean, knowing that the system would be so gung-ho for guilt and its appearence so obvious that it could take James about ten to twenty years to finally see and breathe freedom, twisted by the system. I did not follow this case closely, knowing Melissa's problems with that area, I knew that justice would not be served in this case, as in Jordan Brown and in the case of the West Memphis Three. Their mindset is smaller than their common sense.

The  defense counsel was not aggressive enough with everyone who was in that house that night. In fact, the defense counsel was not agressive with the mom and stwepdad as well. The goal is to fly them off the hinges, make them utter something or do some physical act to ruin their credibility. The reason the jury voted guilty, outside reading the transcript is that the jury could not think that someone else that night raped that little girl.

So on what ground would I appeal. It seems that the court did not make any mistakes thought the appellate court can throw out the case on grounds of judicial misconduct in the that the judge should have dropped all the charges and freed the defendent once he felt the prosecution could not prove their case. Let us hope that when this case is overturned, the prosecutor desides never to try it again and go after the right person.

Then there has to be DNA evidencce in this case, such a rape could not be covered up fast enough. If DNA evidence had indeed not pointed to James, then no charges would ever been filed against him. If someone tried to clean up the victim of that evidence, even that would be obvious if the victim could communicate about her rape, but since the victim was a baby, no such communication could take place.


The only other way James to be freed is the real doer confessing to the crime. Unlike murder, rape is easy to repeat again and again. For person who raped a baby, doing it again to some other infant or young toddler or even an older person would be so irresistable again. Maybe he would get caught this time. There will be no one to frame this time. Facing serious time in jail, the real rapist would talk about his life, eventually confessing to the crime that put James in jail. If not, he must be the lowest crook on this planet. with no conscience or regret, but the similarity to his crime to the crime the cops thought they solved will be damning.

BTW, if there is no DNA evidence, it easily clears James Prindle. If a younger kid committed the rape (one of the brothers), perhaps they could not ejculate at the time or they were crafty at pulling out at orgasm, catching the amor of their crime in a tissue or some other unobvious thing, getting rid of it later. Though it would not get rid of all "evidence". Pubescent males do leave some evidence if they raped without a condom. Ever heard of pre-ejacultate material? It is the one reason women get pregnant even if the practice coitus interruptus or the rhythm method. That male extra is a fluid that various from male to male and from the time they last "did it". Many men might not make enough, but others can make enough, so containing enough sperm to cause a pregnancy or in cases of rape, enough DNA to send them to prison. It is one of those things.



It looks like it could take two decades but there is a chance of DNA, the real killer or a technicality overturning this "textbook" unconstitutional verdict.

Corruption is unbelievably high in that region. It's hard to imagine it is even possible for someone to get a fair trial in Memphis and its surrounding areas. At this rate I think his best bet is the higher courts. Perhaps even taking advantage of the recent SC rulings regarding plea deals. I need to look them up and see how they would impact his case though. I was really only considering them previously in terms of how they might impact people with LWOP.

Does anyone know if Adam testified at James' trial? He was one of the people alone with the baby. I'd love to see his statement or even his testimony.

Here's an article about the Supreme Court rulings on plea bargaining. I've been trying to find out how this affects older cases, but I have to wait to hear back from someone I know who is trying to use this.

The judge may send James himself far away, and he may take comfort that the appeal will be heard in some distant courtroom, but the politics of this case are going to stay in Memphis where this whole cluster’frig’ was incubated.
 
We will keep shining light on James’ story and all the people in it. We will bring worldwide attention to James’ situation because that is the best way to assure his safety. We will become a huge pain-in-the-behind to the old boys network.
 
Memphis, we’re not going away. Get used to it.
