Case timeline for Cristian Fernandez

The following will be updated as I find new information to add.

January 14th, 1999 - Cristian Fernandez was born to 12 year old Bianella Marie Susana.

2001 (?) - "Mason said [Cristian] Fernandez was found naked and dirty wandering in a hotel parking lot when he was 2 years old. Since his guardian was arrested on charges of neglect and possession of drugs and his mother was only 14, both Fernandez and Susana were placed in foster care."

October 2010 - Cristian's stepfather committed suicide by shooting himself with a gun in front of the kids. This was after he had been reported for physical abuse of Cristian.

January 22nd, 2011 - Bianella Marie Susana, Cristian's mother, takes 2 year old David for treatment of a broken leg. She originally said he fell, later claiming that Cristian broke David's leg while wrestling with him.

March 14th - Date that David Galarriago received head injuries that caused his death (see video on link below).

"Instead of calling 911, police say Susana cleaned the toddler, changed his clothes, put ice on his head, and then got on the computer to research concussions, reports CBS affiliate WTEV."

June 3rd, 2011 - Cristian is indicted for first-degree murder in his brother's death.

June 5th, 2011 - The media reported that Cristian was examined by two forensic psychologists. Both concluded that he was "emotionally underdeveloped but essentially reformable despite a tough life."

Cristian was moved from a juvenile holding facility to the Duval County jail and housed in a juvenile section of the jail.

June 8th, 2011 - Cristian is arraigned in court for his first-degree murder charge. His attorney said he was competent, but wanted him examined by some other experts. He also said Cristian was being housed in isolation in the Duval County Jail for adults and that he would like to get him into the Duval Detention Center (for juveniles). Cristian waived his right to a speedy trial.

Prosecutor Mark Caliel requested a media gag order. "Further comments to the media, especially pertaining to the background of the defendand and the facts and circumstances of the case appear to be in violation of the rules of professional conduct," Caliel stated. "We have a concern that any comments being interpreted by a potential jury pool could inhibit our ability to fairly and adequately try this case."

July 22nd, 2011 - Cristian appears for his pretrial hearing. The Florida State Attorney's Office charges him with first-degree murder as an adult. The gag order on the case remains as Judge Mallory Cooper did not lift it.

August 17th, 2011 - A third psychiatric exam was ordered for Cristian.

August 27th, 2011 - Biannella wrote a three-paged letter to a newspaper describing some of the circumstances leading up to the death of David. She discussed how D.C.F. had let her and her children down by placing the children on a waiting list for therapy and failing to intervene and provide help sooner.

The above article also states that Biannella surrendered her rights to her children legally the week prior to the writing of the article published on September 1st.

September 1st, 2011 - The Florida Times Union received a subpoena to turn over the letter Biannella sent to the State Attorney's Office.

September 9th, 2011 - The Florida Times Union refused to turn over Biannella's letter to the newspaper in court, citing the first amendment of the constitution.

October 5th, 2011 - Cristian's had a court date.

November 16th, 2011 - Media reports that the prosecution offered Cristian a plea deal and that the defense planned to reject it.

December 5, 2011 - Media reports that the defense officially rejected the plea deal. Angela Corey announced plans to seek a third indictment. Trial date is set for late February.

January 6, 2012 - Media reported that Angela was successful in seeking a third grand jury indictment against Cristian wherein he put in a plea of not guilty.

February 2nd, 2012 - Public Defender Matt Shirk withdrew from Cristian's case after a coalition of private attorneys who were assisting on the case motioned to take over.

March 28th, 2012 - Cristian's mother accepts a plea of guilty to aggravated manslaughter. She will receive a minimum of 13 years or a maximum of 30. She admitted to neglecting Cristian and her other children.
