Boys, ages 12 and 15, to appear in court Thursday
Colt Lundy and Paul Gingerich will be in court in Warsaw on Thursday. The boys, ages 15 and 12 respectively, are accused of shooting and killing Lundy's stepfather, 49-year-old Phillip Danner.
The prosecutor has filed a motion to try the two of them together, however the defense wants separate trials. The two are charged as adults in the murder case.
Police say Lundy started planning to kill his stepfather at least two weeks before the shooting. Gingerich was identified as the other, suspected shooter. Police say both boys fired two shots in the attack that killed Danner in his home on April 20th.
If convicted the boys could spend up to 45 years behind bars.
