I have to lob this salvo about this case. It shows the utter gullibility of the police and the prosecutors who love them so much that need to get married. Why would a police department depend totally on people of questionable standards? That is the case here. And a person's past record and reputation has derailed many a civil or criminal record.
Take people like Josh Gouker and his side of the family. Such a good upstanding man until you look under the hood at the criminal inside. All that is needed is for the defense to question Gouker by using his past against him.
He was in prison for assult and battery for the better part of eight years. Better yet he was on parole when he got his son back. The revocation of that parole would have been easy enough to charge him with kidnapping before he had a chance to frame his own son, the very person he kidnapped with a murder the boy did not commit.
He cannot face that one down. By this time next year, Gouker will face death in a Jefferson County courtroom for capital murder once a full-blown trial or dismission many months before October proves that Gouker killed Trey Zwicker then planned with his family members to frame his own son for the crime. No amount of prosecutorial misconduct will prevent Gouker next year begging the court for mercy for this crime; a crime where he will stay in prison until his natural death. All is needed is for the prosecutor to confess they were lied to and the cops to agree they overstepped their bounds instantly believing a convicted without asking themselves why Gouker's story does not match the crime scene.
What could be holding back the truth in this case and the fools it made of even the father of the victim, who may need years to actually accept a man killed his boy because he was giving him a hard time.
I stand by my latest interpretation of what really went down that night last May. Trey Zwicker's petty criminal tendencies played into Gouker's plans to corrupt his son. It was Mr. Gouker in the school parking lot with the baseball bat and maybe his bare fists and brute strength. If he can brutally assult old men and police, what measure is a boy half his size?
